State Fail to File Defense in UGX 1.5 Billion Digitalk TV Rights Violation Suit, High Court Adjourns

KAMPALA UGANDA: 30 September 2026- Kampala High Court Judge Joyce Kavuma has adjourned a human rights enforcement application filed by Digitalk TV and staff against Attorney General, jailed Maj. Gen. James Birungi D/AIP Ndyanabangi George, D/AIP Birungi (Katwe Police), AIGP Tom Magambo, and Kisembo (Criminal Intelligence Katwe), where over Ugx 1.5bn is sought as compensation and damages.

The judge who is currently handling election petitions in Masaka told applicants through the registry that another date will be communicated via Electronic Court Case Management Information System (ECMISS).

It should be recalled that on March 10, 2022, security raided Digitalk TV premises, arrested nine staff members, and gadgets, including computers, phones, documents, and other broadcasting tools confiscated today.

With any arrest and or search warrant, under the command of and knowledge of the respondents Norman Tumuhbise – Team Leader Mukose Arnold Anthony – ProgrammesDirector, Bikobere Farida – DirectorAdministration/Show host, Kato Tumusiime – Lawyer/Organization Legal Officer, Luwedde Lilian, Mukiibi Jeremiah – Head Production, Nabukeera Teangel Teddy – Producer, Wabyona Jeje Jacob – Intern, and Tulyahabwe Rogers – Show Host were arrested, detained beyond 48 constitutional hours, held incommunicado for over six days, tortured at Chieftaincy of Military Intelligence (CMI), Mbuya.

Even when Tumuhimbise and Bikobere were charged with Cyber Stalking the person of the president and annoying the person of the president, charges were dismissed for want of prosecution and to-date, all their property have never been returned.

Appearing for the applicants, Counsel Kakuru Tumusiime from Kiiza and Mugisha Advocates revealed that they are yet to receive responses from the respondents.

Among the declarations sought include the return of all the confiscated equipment and property, everything was unconstitutional and sought over 1.5 Ugx bn shilling in damages and compensation.

However, only seven out of the nine affected journalists filed the application.
